TERMS OF SERVICE

BY ACCESSING OR USING CROWDCTRL, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.

1.1 About CROWDCTRL
CROWDCTRL ("the Platform") is a real-time audience engagement tool for DJs and live music events. It is operated by Chris Watt (ABN 84 814 621 323), trading as CROWDCTRL ("we", "us", "our"), based in Perth, Western Australia. The Platform enables DJs to collect live genre votes, song requests, and audience messages from event attendees via QR code.

1.2 Pilot Programme
CROWDCTRL is currently operating as an invite-only pilot programme. Access is granted at our sole discretion and may be withdrawn at any time without notice. The Platform is provided on an as-is basis during this period. Features, pricing, and availability are subject to change without notice.

1.3 Eligibility
You must be at least 18 years of age to create a DJ account on CROWDCTRL. By registering, you confirm that the information you provide is accurate and that you are authorised to use the email address provided.

1.4 Accounts and Security
You are responsible for maintaining the security of your account credentials. Do not share your password or invite code with others. We reserve the right to terminate accounts that are found to be shared, abused, or used in violation of these Terms.

Audience members may submit genre votes, song request titles, and short messages through the vote card interface. By submitting content, you grant us a non-exclusive, royalty-free licence to store and display that content within the Platform for the duration of the event session. Song request and message content is visible to the DJ only; it is not published publicly.

1.7 Subscriptions and Payments
DJ subscriptions are processed by Stripe, Inc. on our behalf. By subscribing, you agree to Stripe's Terms of Service in addition to these Terms. Subscription fees are charged in AUD unless otherwise stated. We do not store or have access to your payment card details at any point — this data is held exclusively by Stripe.

During the pilot programme, subscription plans may include free trial periods. Free trials begin on the date of signup and convert to a paid subscription unless cancelled before the trial end date via your Stripe billing portal.

1.8 Refunds
Subscription fees are non-refundable except where required by Australian Consumer Law. If you believe you are entitled to a refund, contact us at the address below within 14 days of the charge.

1.9 Ko-fi Donations
CROWDCTRL integrates with Ko-fi to allow DJs to receive tips from their audience. Ko-fi transactions are conducted directly between the audience member and the DJ via Ko-fi's platform. We are not a party to these transactions and accept no responsibility for them. Ko-fi's own terms and privacy policy apply.

1.10 Termination
We reserve the right to suspend or terminate your access to CROWDCTRL at any time, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Platform ceases immediately.

1.11 Disclaimer of Warranties
To the maximum extent permitted by law, CROWDCTRL is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any real-time data displayed.

1.12 Limitation of Liability
To the extent permitted by Australian law, our total liability to you for any claim arising out of or in connection with these Terms or your use of CROWDCTRL shall not exceed the total subscription fees paid by you in the three months preceding the claim.

1.13 Governing Law
These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

1.14 Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated to registered DJ accounts by email where practicable.

PRIVACY POLICY

WE COLLECT ONLY WHAT WE NEED TO RUN THE PLATFORM. WE DO NOT SELL YOUR DATA.

2.1 Who We Are
This Privacy Policy explains how Chris Watt (ABN 84 814 621 323) trading as CROWDCTRL ("we", "us") collects, uses, and protects personal information in connection with the CROWDCTRL platform, in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2.4 Data Storage and Retention
DJ account data and event session data are stored in Google Firebase Realtime Database (Asia Southeast 1 region). Firebase is operated by Google LLC and subject to Google's data processing terms. Event session data (votes, requests, messages) may be retained for up to 90 days after the event for debugging and analytics purposes, after which it is deleted. DJ account data is retained for the duration of the active subscription and for 30 days following account deletion.

We do not sell, rent, or trade your personal information to any third party. We share data with third-party service providers only to the extent necessary to operate the Platform (as listed above). We may disclose information if required to do so by law or in response to a valid legal request.

2.7 Cookies and Tracking
The CROWDCTRL platform uses browser localStorage to persist DJ configuration settings across sessions. We do not use advertising cookies or third-party tracking pixels. Firebase and Netlify may set operational cookies for session management and performance monitoring.

2.8 Your Rights
Under the Australian Privacy Act, you have the right to access the personal information we hold about you and to request corrections. You may also request deletion of your account and associated data. To exercise these rights, contact us at the address below. We will respond within 30 days.

2.9 Security
We implement appropriate technical measures to protect your personal information, including Firebase Authentication, encrypted HTTPS connections, and Firebase Realtime Database security rules that restrict data access to authenticated sessions. No system is completely secure, and we cannot guarantee absolute security of your data.

2.10 Children's Privacy
CROWDCTRL is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. Audience members who use the vote card do so anonymously without creating an account.

2.11 Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top of this page will reflect any changes. Continued use of the Platform after changes are posted constitutes acceptance of the updated Policy.
